Privacy Policy – Driver Mobile App

1. PARTIES

This Contract (shall be referred to as “Agreement” hereinafter) will be taken into effect between Hire and Fyre FZE LLC (“First Party” hereinafter) and the driver who downloads this app and who obliges to work as a Third Party Contractor by listing his/their Road Side Assistance Vehicles in order to be a part of the Services offered by Hire and Fyre FZE LLC through their Website/Mobile Application. The parties have entered into this agreement under the following Terms and Conditions.

2. SERVICES

The Services rendered between the two parties relate to rental of any equipment listed on the First Party’s website or mobile application and the following Terms and Conditions shall apply on any of the Services provided by the First Party.

3. TERMS OF AGREEMENT

This agreement becomes effective once the Second Party enrolls with Hire and Fyre FZE LLC’s online hosting platform to list their equipment(s) with an intention to generate revenue from the Services/Opportunities passed on by Hire and Fyre FZE LLC:

3.1. Online Enrolment: The Second Party will be eligible to register themselves/their organizations in the following manner:

1st Scenario:

If the recovery is owned by an owner (Second Party) whose name is on the Registration Card then following documents have to be submitted:

  • Valid Registration Card – Front and Back
  • Valid Emirates ID of the Owner (Second Party) – Front and Back (Owner’s name should match with name on the Vehicle’s Registration card)
  • NOC from the Owner (Second Party) under whom the Road Side Assistance vehicle is registered who would authorize Hire and Fyre FZE LLC to list Second Party’s equipment(s) on Hire and Fyre FZE LLC’s online hosting platform to be able to provide services with an intention to generate revenue. NOC has to be signed by the Owner whose name is on the Registration Card mentioning the name and mobile number of the driver assigned.
  • Owner’s (Second Party) Mobile Number:

  • Owner’s (Second Party) Bank Account Details with IBAN Number.
  • Assigned Driver’s Name – Field Representative of the Owner (Second Party)
  • Assigned Driver’s Mobile Number
  • Assigned Drivers Valid License Copy – Front and Back
  • Assigned Drivers Valid Emirates ID – Front and Back

2nd Scenario:

If the recovery is owned by a company/entity/organization/corporate then the following documents have to be submitted: a) Valid Registration Card – Front and Back

  • Valid Registration Card – Front and Back
  • Trade License of the Company/Entity/Organization/Corporate (Second Party) under which the recovery is registered.
  • Valid Emirates ID of the Owner(s) (Legal Representatives) whose names are on the Trade License – Front and Back.
  • NOC from the Company/Entity/Organization/Corporate under which the Road Side Assistance Vehicle is registered that authorizes Hire and Fyre FZE LLC to list the Second Party’s equipment(s) on Hire and Fyre FZE LLC’s online hosting platform to be able to provide services with an intention to generate revenue. NOC has to be signed by the Legal Representative of the Second Party whose name(s) is/are on the Trade License OR by their approved signing authority who may possess a Notarized Power of Attorney with their name mentioned on it. The approved signing authority would automatically become their Legal Representative should be the case and would have to submit the documents mentioned in point c.
    The NOC should also mention the name and the mobile number of the driver assigned.
  • Management Representative Emirates ID – Front and Back

  • Management’s Representative’s Email ID.
  • Assigned Driver’s Name and Mobile Number.
  • Assigned Driver's valid License Copy – Front and Back.
  • Assigned Driver's valid Emirates ID – Front and Back.
4. Special Terms and Conditions
  • The Second Party agrees to have a GPS (Global Positioning System) device in their roadside assistance vehicle that will have an open API making it compatible to integrate with the First Party’s Website and Mobile Application thereby allowing the representatives of the Second Party to monitor the current location of the roadside assistance vehicle thereby allowing the First Party to pass the requests being booked by the First Party’s Website or Mobile Application.
  • The Second Party acknowledges that under No Circumstances, they or their drivers or any of their associates or representatives would tweak/modify/remove/damage/change the fitted GPS device. Should the need arise of disconnecting the GPS device during the periodic Maintenance or for any other reason, the Second Party is obliged to inform the First Party seeking their consent before tweaking/removing/modifying/changing the GPS device. The GPS device can only be tweaked/removed/modified/changed upon receiving consent from the First Party. The Second Party understands and agrees that knowingly or unknowingly, under no circumstances they would give the access to the GPS systems installed in their vehicles to a Third Party for whatsoever may be the reason.
  • The Second Party agrees that Hire and Fyre FZE LLC would make them Weekly Payments (8th, 15th, 23rd and 31st of every month) in their registered bank account for the Trips made by the Road Side Assistance Vehicle and that were paid by a Credit or a Debit Card by the End user.
  • The Second Party Agrees that they would make Weekly Transfers (7th, 14th, 21st and 28th of every month) in Hire and Fyre FZE LLC’s registered Bank account for the Service Charges Paid by the End user for the Trips made by the Road Side Assistance Vehicle and that were paid in Cash by the End user.
  • Hire and Fyre FZE LLC does not accept any responsibility or liability whatsoever for any damages caused to the End User’s Asset while loading or unloading of the Asset on and off the Road side assistance vehicle and the Second Party fully understands that it is entirely their responsibility and any damages/claims that might arise under any circumstances with respect to the end user or a third party, the Second party acknowledges to settle it with the end user or the third party in question. Neither Hire and Fyre FZE LLC nor any of its partners, employees, Directors can or will be involved in any claims, government/legal issues that might arise now or in the future due to the negligence caused by the Second Party or any of its Associates.
  • The Second Party acknowledges the fact that Hire and Fyre FZE LLC is a service provider that hosts their equipments on its website and mobile application. Hire and Fyre FZE LLC is not obliged to provide/compensate for the following:
    • Fuel for trips made by the Road Side Assistance Vehicle.
    • Traffic Fines that might arise while the Road Side Assistance Vehicle is parked, stored or servicing the end users.
    • Driver’s Salary, Driver’s Insurance, Driver’s Workman’s compensation, Driver’s Accommodation driving the Road Side Assistance Vehicle.
    • Vehicle Maintenance Cost, Repair Charges, Accident Repairs, Breakdown costs, Vehicle annual passing and Insurance, Road Permits, Loading and Unloading Permits and any other Permits for the vehicle to work legally on the roads of UAE.
    • Damages caused to a Third Party or the end user due to the negligence of the Driver.
  • The Second Party acknowledges that it will keep 1st Party informed in advance by email, call or what’s app at least 1 month in advance if the following situations might arise:
    • If the assigned driver is due for his annual leave and wants to leave the UAE.
    • If the assigned driver would want to discontinue the service for the Second Party/Organization
    • If the second party decides to change the assigned driver.
    • If the second party decides to sell the listed Road Side assistance vehicle.
  • The Second Party acknowledges that it will keep 1st Party informed in advance by email, call or what’s app at least 2 hours in advance if the following situations might arise:
    • If the assigned driver calls in sick for the day or for the next consecutive days.
    • If the assigned Road Side Assistance is due for a Preventive/Planned Maintenance schedule.
  • The Second Party acknowledges that it will keep 1st Party informed in advance by email, call or what’s app Immediately if the following situations might arise:
    • The Assigned Roadside Assistance Vehicle meets with a major or a minor accident while travelling to the point of pick up or while travelling to the point of drop or even while working independently.
    • If the end user is not making the agreed payment or if the end user denies to make any payment at all.
  • The Second Party is entitled to make sure a replacement driver or a replacement roadside assistance vehicle is arranged well in advance if any of the situation mentioned in clause(s) and sub-clause(s) under points f), g) and h) occur at any instance, thereby making sure Hire and Fyre FZE LLC’s Operations are not affected.
  • The Second Party acknowledges that they would make sure their road side assistance vehicles are fit to use at all the times with all the legal compliances in place for any bookings received from Hire and Fyre FZE LLC’s Website or Mobile Application. They would provide a Third Party Certificate of their Loading and Unloading Mechanism from any Municipality approved Third Party Safety Company of their choice.
  • The Second Party acknowledges that the following Documents and equipment’s would always be on their Road Side Assistance Vehicles while servicing the End users who have made a booking through Hire and Fyre FZE LLC’s website or Mobile Application:
    • Safety gear – High Visibility Safety Jackets, 2 Safety Cones, High Grip Gloves
    • Vehicle Original Registration
    • Driver’s License and Emirates ID
    • Tool Box – Optional
  • Cookies are small bits of data cached in a user’s browser. We utilize cookies to determine whether or not you have visited the home page in the past. However, no other user information is gathered. We may use non-personal aggregated data to enhance the operation of our websites and/or the apps or analyze interest in the areas of our websites and/or the apps. Additionally, if you provide us with content for publishing or feedback, we may publish your username or other identifying data with your permission. You may refuse to accept cookies by activating the setting on your browser which allows you to refuse the setting of cookies. However, if you select this setting, you may be unable to access certain parts of our websites and/or the apps. These policies would be changed or updated occasionally to meet the requirements and standards. Therefore the end users are encouraged to frequently visit these sections in order to be updated about the changes on our websites and/or the mobile app/s. Modifications will be effective on the day they are posted.
  • We take appropriate steps to ensure data privacy and security including through various hardware and software methodologies. However, we cannot guarantee the security of any information that is disclosed online. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our websites and/or the apps, you are responsible for keeping this password or One-time password (OTP) confidential. We ask you not to share a password or OTP with anyone. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our websites or the apps; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent un-authorized access. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the Contact Us section below.
  • We are not responsible for third party sites to which our websites or the apps links. If the user provides any information to such third parties different rules regarding the collection and use of their personal information may apply. We strongly suggest the user reviews such third party's privacy policies before providing any data to them. We are not responsible for the policies or practices of third parties. The information practices of those third-party sites linked to our websites and/or the apps are not covered by this Privacy Policy. These other third-party sites may send their own cookies or clear GIFs to users, collect data or solicit personally identifiable information. We cannot control this collection of information. The user should contact these entities directly if you have any questions about their use of the information that they collect.
  • Personal Data Collection:

    We may process personal information that identifies you as an individual or that relates to an identifiable person (Personal Information) such as:
    • Personal Details and Contact Information: Name, emirates ID number, address, e-mail, telephone, physical signature and electronic signatures;
    • Professional Affiliations: Business name, title, and address;
    • Financial Information: Payment card number, bank account number and account details;
    • Operational Data: Transactions, sales, purchases, uses, supplier information, credentials to online services and platforms, internet domain or IP address, and electronic content produced by data subjects using company systems, including online interactive and voice communications, such as blog, chat, webcam use and network sessions;
    • Any further information required for credit verification, compliance/ethics checks or customer due diligence; We may collect Personal Information in various ways, such as: when you interact with one of our websites and/or the apps; when you enter into a transaction or contractual arrangement with us; when you register for services; when you make purchases via our websites and/or apps; when you provide feedback data; when you visit our offices or we visit you; when you contact our customers services; or in connection with your inquiries and communications with us. Additionally, we may automatically collect or process Personal Information as part of the operation of the services or during the course of your activities on or use of the websites and/or the apps.
    • We also collect certain anonymous data regarding the usage of our websites and/or the apps. This information does not personally identify users, by itself or in combination with other information, and is gathered to improve the performance of the websites and/or the apps. The anonymous data collected by us can include information such as the type of browser you are using, and the length of the visit to the websites and/or the apps.
    • It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes during your relationship with us.
  • User Rights:

    To the extent a specific element of us processing of the user’s Personal Information relies upon their consent, the user may withdraw their consent at any time with future effect. A withdrawal of the consent will not affect the lawfulness of the processing prior to the consent withdrawal. We only want to maintain only accurate information about users. The users have the right to request that we rectify inaccurate Personal Information concerning them. Depending on the purposes of the processing, the user may have the right to have incomplete personal information completed, including by means of providing a supplementary statement. The end user has the right to obtain from us confirmation as to whether or not Personal Information concerning you is being processed, and, where that is the case, to request access to your Personal Information. This access information includes, among others, the purposes of the processing, the categories of Personal Information concerned, and the recipients or categories of recipient to whom the Personal Information has been or will be disclosed. However, this is not an absolute right and the interests of other individuals may restrict the user’s right of access. For their protection, we may only implement requests with respect to the Personal Information associated with the particular email address that the user uses to send us their request, and we may need to verify the user’s identity before implementing their request. Under certain circumstances, the user has the right to ask us to erase Personal Information concerning them and we may be obliged to erase such Personal Information. Please note that Hire and Fyre FZE LLC may need to retain certain information for recordkeeping purposes and/or to complete any transactions that the user began prior to requesting a change or deletion (e.g., when the user makes a purchase or enters a promotion, they may not be able to change or delete the Personal Information provided until after the completion of such purchase or promotion).
    Under certain circumstances:
    The user has the right to ask us to restrict the processing of their Personal Information. If so, the applicable Personal Information will be marked and may only be processed by us for certain purposes.
    The user has the right to ask us to provide them with their Personal Information, in a structured, commonly used and machine- readable format and the user has the right to transmit that data to another entity without hindrance from us
    The user can object on grounds of relating to their particular situation at any time to the processing of their Personal Information by us and require us to stop processing their Personal Information. The right to object may especially apply if we collect and process your Personal Information for profiling purposes in order to better understand your interests in our products and services or for direct marketing. If the user has a right to object and they exercise this right, we will no longer process your Personal Information for those purposes. The user may exercise this right by contacting us. The right to object may, in particular, not exists if the processing of their Personal Information is necessary to take steps prior to entering into a contract or to perform a contract already concluded. We will not retain the user’s Personal Information longer than is necessary and permitted in light of the purpose(s) for which it was obtained. The criteria used to determine our retention periods include: (i) the length of time we have an ongoing relationship with the user; (ii) whether there is a legal obligation to which we are subject; or (iii) whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation or regulatory requirements).
    We will only use your Personal Information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.
    If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so and to the extent required by applicable law, seek your consent.

  • Location Usage:

    The Key functionality of this app is fetching location is being fetched for better accurate positioning so that it is easier to determine the closest driver from the end user, to reduce the Turn Around time and enhance the end-user experience. The location is only fetched when a new ride request comes and the drivers show themself "online"/ "available" so by the app mechanism location can be grasped when the app is in any of one state "background” / “when the app is closed” / “when the app is not in use”. The app doesn't fetch users' location when they are "offline" / "logged out".
  • User and Disclosure of Information

    Except as otherwise stated below, Hire and Fyre FZE LLC will not sell, trade or rent your personally identifiable information collected on our websites and/or the apps to others.
    We and our service providers use Personal Information for legitimate business purposes including:
    • Enabling us to fulfill the user’s requests when the user’s contact us via one of our online contact forms or otherwise, for example, when they send us questions, suggestions, or when they request a quote for or other information about our services.
    • To complete the transactions and provide the user’s with related customer service.
    • To send administrative information to the user, such as changes to our T&C’s and policies.
    • We will engage in these activities where we have a legitimate interest, to manage our contractual relationship with the user, and/or to comply with a legal obligation.
5. Termination:

This Agreement shall commence on the date accepted by the Second party and shall continue until terminated as set forth herein. Hire and Fyre FZE LLC may terminate this Agreement immediately, without notice, for the Second Party’s breach of this Agreemen

6. Governing Law and Jurisdiction:

This Agreement shall be governed by UAE laws as applied by the Courts of the Emirate of Sharjah. This Contract and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of the United Arab Emirates and shall be settled before the competent courts of the Emirate of Sharjah.

6.1 MINORS

Hire and Fyre FZE LLC does not knowingly collect personal information from minors under the age of 18. Minors are not permitted to use the Hire and Fyre FZE LLC’s websites and/or the apps or services, and we request that minors under the age of 18 not submit any personal information to the websites and/or the apps. Since information regarding minors under the age of 18 is not collected, we do not knowingly distribute personal information regarding minors under the age of 18.

6.2 ELIGIBILITY

The end user must be at least 18 years of age to create an account on Hire and Fyre FZE LLC’s. By creating an account and using our websites and/or the apps, you represent and warrant that: you can form a binding contract with us, you are not a person who is barred from using our service under the laws of UAE or any other applicable jurisdiction - you will comply with this Privacy Policy and all applicable local, state, national and international laws, rules and regulations.
